In Florida, a Qualified Domestic Relations Order (QDRO) is a judicial order, entered as part of property division in a divorce that splits a retirement plan or pension plan by recognizing joint marital ownership interests in the plan, specifically the former spouse's interest in that spouse's share of the asset.
A QDRO's recognition of spousal ownership interest in a plan participant's (employee's) pension plan awards a portion of the plan participant's benefit to an alternate payee. An alternate payee must be a spouse, former spouse, child or other dependent of the plan participant. Unfortunately, we have had clients who were divorced years ago and thought their marital portion automatically transferred once the divorce is over when it doesn’t.
QDRO’s are normally done after the divorce, one must be done for each retirement or pension account you were awarded, and most divorce attorney’s do not provide this service. The few attorney’s that do provide this service charge an hourly rate, but at My DUI Guy, P.A., we charge a simple flat fee no matter how much work needs to be done. We also work closely with each financial institution to ensure you will receive your marital portion as soon as possible.
